Maybe work on not committing a disproportionate amount of crime.

That said, a business should be able to discriminate any way they see fit, let the market decide when someone goes too far.

The keyword is automatically, which means the applicant failed to inform the employer of their criminal background. This is on the applicant, not the employer.

If I'm hiring someone to smoke crack, get girls pregnant, or bomb a standardized on my behalf, then maybe the criminal background check could be a disparate impact standard. But to handle money and merchandise, hell no.
