Hook 'em 12th Man? Maybe A&M and Texas can split legal fees on trademark infringement suits.
quote:These are copyright issues, not trademark issues. The answer, however, is yes if the college owns the copyright in the fight song and has not licensed the HS to perform the song (subject to the defense of fair use). Re crowd chants, my guess is that it wouldn't be copyrightable as an original work in the first place.
So, if a HS uses the music of a college fight song as their fight song does that mean that the college can sue the HS? And if one team uses one of the same crowd chants as another team at some other level, can they sue as well?
quote:You're joking, but t.u. actually does have the Hook em hand sign as a registered and protected Trade Mark. See the following link:

And I'd probably do it in the Eastern District of Texas and drag their asses to some remote place like Marshall that takes more than a day to get to from Seattle

The University also has had issues with its own student organizations using University trademarked material. The Barbecue Club was told their logo was too similar to the University seal, and the club was forced to change their logo. In 1999, the student organization UT Students Against Sweatshops was told their name violated the University's rules, because including the letters "UT" in their name gave the appearance the University supported views of the organization.

This might just be urban legend, but didn't t.u. sue the City of Fort Worth, because their longhorn logo looked too much like the schools?

If you actually tried to sue he'd eat your liver with fava beans and a nice Chianti. It's best to play nice and share rather than pissing away student's tuitions tilting at windmills.

Unless you protect it, then every swingin' **** in football will be calling themselves "The 12th Man".
Do you want to see that happen?
